My friend found a deal for a well known blind company (don't know if i can name them?) and a man came to her house and measured up. When the man came to fit them my friend asked him to measure up two windows upstairs as she would like them doing too. So he measure up and he gave her a price of about £90 with the deal that was on at the time. She told him she'd let him know when she wanted them as she'd need to get the money together. After that she kept trying to get in contact with the man to arrange a fitting date and even phoned the company and they kept telling her to contact him after trying for a month she gave up. After that in november she was having some finacial difficulties and phoned the company to cancel the blinds and she would have them at a later date when she could afford them just incase they had told the man about coming to fit them although there was nothing arranged and nothing in writing signed or anything like that and she didn't leave a deposit either.
yesterday she recieved a letter saying they are taking her to court because she owed £134 plus courts costs for these blinds = £289. She phoned the company and they told her the blinds had been made. my friend explained she hadn't been informed of this but explained she still wants them but hasn't got the money yet and that she had phoned to cancel them till a later date 2 months ago and nothing was mentioned then about them been made and nothing at that time had been said about the man even putting in an order. The women was rude and apprupt with my friend and said they would still be taking her to court. my friend told the lady she hadn't signed anything and hadn't got the blinds so how could they take her to court? but they said they still are!
my friend is very distressed at this what can she do and whos at fault? can they do this? any information or advice is helpfull?
Zoe wrote this on my behalf she was very upset hearing me on the phone to [glow=red,2,300]HILLARYS BLINDS.[/glow]
Last year I had 6 blinds from them, the fella came fitted and I paid. Then I asked over two more blinds one for small bathroom window and one for a small bedrom window the guy said it would be £84 which was a good offer due to the fact I had all the other windows done.
Anyhow I did not hear anything and then my circumstances changed I rang the company up and told them it would now be after xmas.
I had a letter saying they were taking me to court for £289 I was shocked so I rang them
the lady had no empathy at all, I told her I still wanted the blinds but I could not say when she was very stroppy to me saying I had to give her a date so I said errrrr well June. she told me that was too long and would be taking me to court. I said what for I still want the blinds but not at the moment and she told me they would still be taking me to court, I just said well I still want them but not right now. she put the phone down on me.
I was hurt I feel they have got me over a barrel I do want them but can not afford them at mo. why would she not listen to me.
So is this company saying that they have made the blinds and have attempted to fit them??
If I was running a company I would not have taken her word as a FIRM order......I would have asked here to sign some form of contract.
Did the man not have some sort of order book (be it real or virtual - I am so old!!! ) in which he would have taken your details and the measurements of the blinds you were asking about. Did he not give you a completion date......the earliest possible date the blinds could be finished and ready for fitting?
Further than that.....did they not phone you to find out when you would like them to be fitted.....even though you said you didn't know when and that you had to get the money together.
They don't know your financial circumstances.....you may have been able to get the money together in a couple of weeks, or a couple of months, or even longer than that.
What sort of company would make a product not knowing these details......one not likely to stay in business for very long I suspect.
If you are certain nothing was signed then you can put it to them that it was a tentative enquiry.....merely to find out whether the price was reasonable and whether you could afford that price.
Write once to their head office....with a copy to the manager of the store concerned. Give very precise and detailed information regarding your concerns over this matter......if you write it so a small child could understand then they won't get confused (again ).
Then wait.....you may well find that they take no further action.
When the guy who finished fitting the other blinds (paid for) I asked him to measure the two windows and give me a quote he told me £84 for the two.
I told him I would get n touch when I was ready for them.
I never signed nothing... I did on the first order which I paid for... but not the other two windows.
I told the blind company when I rang the other day I still wanted them but not at the mo, she said give me a date I said well about june, I know its far off but if I get the money before I will have them but unsure when that will be.
She told me june was too far away and they would be taking me to court I asked why I had not got the blinds she put the phone down on me.
